By accessing or using Tract ("Service"), operated by Tract Intelligence LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
The Service is intended for use by licensed attorneys and their authorized agents. By using the Service, you represent that you are a licensed attorney or are acting under the supervision of one.
Tract is an AI-powered document analysis platform that reviews homeowner association (HOA) governing documents and generates compliance audit reports citing California Civil Code statutes. The Service is a research tool that assists attorneys in identifying potential compliance issues. It is not legal advice, does not constitute legal representation, and does not replace professional legal judgment.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
The Service charges a one-time fee of $99 per case. Payment is processed securely by Stripe. A case includes unlimited analysis runs -- you may upload additional documents and re-run the analysis at no additional charge. Fees are non-refundable except at our sole discretion.
Free-tier access may be granted at our discretion and may be revoked at any time.
Ownership. You retain all rights to the documents you upload and the data you provide. We claim no ownership over your content.
No training. Your documents are never used to train, fine-tune, or improve any AI model. Documents are processed solely to generate your compliance audit report. This restriction is enforced contractually through our AI provider's API terms, which explicitly prohibit model training on API inputs.
Isolation. Each case is accessible only by the authenticated account that created it. No other user can view, access, or download your documents or reports.
Deletion. You may delete any case at any time. Deletion removes the case record, all uploaded documents, and all generated reports from our systems. Deletion is permanent and cannot be reversed.
Retention. Active case data is retained as long as your account exists. We may delete inactive case data (no login or activity for 24 months) after providing 60 days written notice.
You agree not to: (a) upload documents you are not authorized to possess or share; (b) use the Service for any unlawful purpose; (c) attempt to access other users' cases or data; (d) reverse engineer, decompile, or extract the Service's underlying algorithms; (e) use automated tools to access the Service beyond normal usage patterns; (f) resell access to the Service without written authorization.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE ANALYSIS RESULTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
The Service generates compliance analysis based on the documents you provide and the statutes in our database. It may miss violations, misinterpret documents, or cite statutes incorrectly. You are solely responsible for verifying all findings, citations, and conclusions before relying on them in any legal proceeding.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRACT INTELLIGENCE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Tract Intelligence LLC from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in San Diego County, California.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.
